The LaPorte County Sheriff’s Office officially announced July 16, 2013, that resident Stephen Penny will face no charges in the shooting death of intruder Jason Rabe on July 8 in the 6700 East block of County Road 1000 North. The case is closed, police said.
After reviewing police reports, LaPorte County Prosecutor Robert Szilagyi concluded that Penny acted in self-defense when he fatally shot Rabe, 23, of Three Oaks, MI. The investigation revealed that Rabe had broken into Penny’s home near Hudson Lake at about 9 a.m. July 8 and the two struggled, then Penny acted in self-defense and shot Rabe once in the chest. Rabe, who was reportedly armed with a hatchet, was pronounced dead at the scene.
Police said Rabe apparently arrived at the residence on a moped.
